Dear guest welcome to Namaste Apartment. Thank you for taking the time to read our apartment rental Terms and Conditions.
Tenants / Guest who confirm the booking acknowledges and agrees to be bound by the following terms and conditions.
1. PROVISIONS:
The Landlord of Namaste Apartment hereby agrees to rent fully furnished apartment located in Ward No. 2, Lazimpat, Kathmandu.
2. AGREEMENT DURATION:
The said property, including its fixtures and fittings, can be rented from a week, a month to years. This rental agreement may be renewed for an additional period upon mutual agreement with fresh terms and conditions, provided that at least 15 days’ prior notice is given before the expiration of the current agreement.
3. RENT:
3.1 The monthly rent is including services and facilities.
3.2 Payment shall be made in advance on NPR cash or online/bank transfer.
3.3 Rent excludes local government rental tax.
3.4 Rent is non-refundable.
4. Security Deposit:
Normally, we do not require a security deposit from our tenants. However, in certain cases, we may request a deposit equivalent to one month’s rent.
5. LANDLORD’S RESPONSIBILITIES:
5.1 The Landlord shall provide the Tenant with adequate water supply, electricity, and a properly functioning sewage system for the entire apartment.
5.2 The Landlord shall maintain the rented property in a good, tenantable condition and be responsible for any structural repairs, including but not limited to leaking roofs, damaged walls, collapsing boundary walls, major plumbing or electrical breakdowns, sewerage system malfunctions, and septic tank cleaning. However, damages caused by the Tenant’s negligence shall be the Tenant’s responsibility. The Landlord reserves the right to access the premises at reasonable times, with prior notice, to carry out necessary repairs.
5.3 The Landlord shall cover the cost of 100 electricity units per month, as well as charges for drinking water, cooking gas, hot and cold water supply, and cable TV during the rental period.
6. TENANT’S RESPONSIBILITIES:
6.1 The Tenant shall use the rented property for residential purposes only and shall not sublet or transfer possession of any part of the property.
6.2 The Tenant shall not make any structural modifications or alterations without prior written approval from the Landlord.
6.3 The Tenant shall not cause damage to the property and shall maintain it in good condition. Routine maintenance is the Tenant’s responsibility.
6.4 Upon vacating, the Tenant must return the property, including furniture, fixtures, kitchenware, electronic appliances, air conditioning units, washing machine and wall/ceiling paint etc., in good and tenantable condition. Any damages, loss of fixtures, or necessary repairs due to Tenant negligence must be rectified or paid for before checkout.
7. TERMINATION OF LEASE / BOOKING:
7.1 Either party may terminate this lease by providing at least 15 days’ notice.
7.2 Any involvement in or engagement in illegal activities, including drug use, will result in immediate lease termination and eviction without notice. The deposit and advance rent payment will not be refunded.
7.3 Pets are not allowed, if found, will terminate the lease with a 2-days notice.
8. OTHER CLAUSES:
8.1 Smoking is only permitted on the balcony or terrace. Cigarette butts must be disposed of properly.
8.2 The Landlord reserves the right to claim compensation for significant damages, defects, or losses upon termination of this agreement.
8.3 The Landlord is not responsible for any loss, theft, or damage to the Tenant’s property or personal safety due to natural disasters or external circumstances.
8.4 If any unforeseen issues arise, both parties reserve the right to review and amend this agreement through mutual consultation.
9. RENT INCLUDES:
1.) Electricity (additional charges may apply for excessive use).
2.) Drinking water (additional charges may apply for excessive use).
3.) Cooking gas (additional charges may apply for excessive use).
4.) Use of kitchen appliances (fridge, oven, toaster, grinder, water dispenser, cooker, etc.).
5.) Wi-Fi internet.
6.) Power backup for lighting.
7.) 24-hour hot and cold water supply.
8.) Free use of the washing machine.
9.) TV with cable channel connection.
10.) Air conditioning units with remotes in bedrooms.
11.) Iron with ironing board.
12.) Gas-geyser for hot water during winter.
13.) 24-hour CCTV surveillance.
14.) One car or bike parking space.
10. RENT Not ICLUDE / EXCLUDES:

3.) Housekeeping
4.) Rental Tax
